The National Development and Reform Commission ("NDRC") has drawn up the first draft of the "Antitrust Guidelines on Abuse of Intellectual Property Right" ("IPR Antitrust Guidelines"), after four months of drafting work, on October 22, and began seeking feedback from October 23.The IPR Antitrust Guidelines was predicted to be officially enacted in June of next year. Considering many high-tech companies are struggling to cope with the excessive lawsuits of patent trolls, the IPR Antitrust Guidelines will provide certain provisions and rules to restrict the excessive lawsuits. The enactment of the IPR Antitrust Guidelines will make the specific provisions on IPR abuse more concrete than before, further enhance the transparency of antitrust enforcement and improve the normalization of IPR antitrust enforcement.
