Environment Canada has posted a consultation paper on the development of regulations to establish maximum concentrations of BPA in industrial effluents. The regulations were originally proposed in a Risk Management Approach for BPA published in October 2008. The objectives of the consultation paper are to identify affected stakeholders, discuss feasibility and timelines for implementation of the proposed regulations, assess economic impacts, identify sampling and testing methodologies and to solicit comments on the proposed maximum concentrations and the proposed requirement to develop an environmental management system.

The proposed regulations would apply to all facilities that manufacture, process or use (alone, or as part of an industrial chemical) at least 100 kg of BPA per year and would require the implementation of an environmental management system to ensure that the maximum concentration of BPA released in industrial effluents at such facilities is limited to 1.75 μg/L.

Comments may be submitted on the consultation paper until December 27, 2009. The proposed regulations will be published in the Canada Gazette, Part I no later than October 17, 2010, with final regulations to be published in the Canada Gazette, Part II no later than April 2011.
