Ces nouvelles règles auront des conséquences importantes pour les propriétaires canadiens de marques de commerce à compter du 17 juin.

1. Quels sont les principaux changements pour les détenteurs de marques de commerce?

Le Canada va vivre une petite révolution en matière de propriété intellectuelle le 17 juin prochain par la mise en place ou la mise en vigueur de plusieurs amendements à sa Loi sur les marques de commerce. Le Canada va également formaliser son adhésion à deux conventions internationales, le Protocole de Madrid et la Classification de Nice qui va permettre au Canada de rejoindre ce qui se fait un peu partout sur la planète. Il y a également d'autres changements qui vont être mis en vigueur le 17 juin au-delà de ces deux conventions internationales-là. Il y a par exemple la définition de marque de commerce qui va être élargie de façon à inclure plusieurs réalités commerciales qui étaient négligées auparavant. Saveurs, odeurs, hologrammes, textures; des concepts qu'on va pouvoir maintenant protéger en vertu de la Loi sur les marques de commerce au Canada. Autre changement aussi à venir c'est un changement au niveau des coûts. L'Office de la propriété intellectuelle du Canada, l'OPIC de son petit nom, va modifier sa tarification de façon à tenir compte du nombre de classes couvertes par un dépôt de marque au Canada ou un renouvellement de marque. Il faut savoir que la Classification de Nice compte 45 classes de produits et services. Donc, plus il y aura de classes, plus les coûts vont être importants lorsqu'on va vouloir déposer ou renouveler une marque de commerce.

2. Quel est l'impact de l'adhésion au Protocole de Madrid?

Le Protocole de Madrid va amener des changements importants à tout titulaire canadien de marque de commerce qui cherche à protéger sa marque de commerce à l'international. L'adhésion du Canada va lui permettre de rejoindre un groupe de presque 120 pays, dont les principaux partenaires économiques du Canada. C'est une procédure simplifiée. C'est une procédure qui permet de protéger sa marque donc à l'aide d'une seule demande dans presque 120 pays. C'est une procédure qui permet donc au-delà des aspects techniques les plus mécaniques de réduire les coûts de façon importante. Plus vous avez de pays couverts par la demande, plus importants seront les avantages financiers de telle sorte que si votre intérêt comme entrepreneur se limite à trois, quatre pays, il n'y a peut-être pas nécessairement avantage à profiter du Protocole de Madrid parce que les coûts d'entrée vont être plus importants. Mais si au contraire vous avez un intérêt pour cinq, six, dix, vingt, cinquante pays, là il y a un avantage indéniable à profiter du Protocole de Madrid.

3. Quels sont les avantages et les inconvénients de l'élimination de l'obligation d'usage?

Il s'agit d'un amendement important à la Loi sur les marques de commerce. Je me rappelle que lorsque le législateur a présenté son projet il y a quatre ou cinq ans c'est un sujet qui a soulevé les passions. Pourquoi? Parce que ça change un peu la façon d'obtenir une marque au Canada. Jusqu'à maintenant, tout déposant de marque devait produire une déclaration qui confirmait qu'il avait débuté l'emploi de la marque au Canada pour obtenir son enregistrement. Cette obligation-là va être retirée. Donc il y a une mesure d'entrée qui est éliminée. Et ça a un avantage parce que ça facilite dorénavant la procédure qui va être plus rapide, moins coûteuse, et parce que le déposant n'aura plus à produire une déclaration d'usage. Mais en même temps ça ouvre la porte à des gens mal intentionnés de pouvoir obtenir un enregistrement de marque de commerce à l'égard d'une marque pour laquelle ils n'ont pas véritablement d'intention d'emploi, simplement parce qu'ils n'auront pas non plus à produire une déclaration d'emploi pour obtenir l'enregistrement au Canada.
