Data is the new big thing. It is what drives many equally new technologies (e.g., artificial intelligence, big data analytics, smart/autonomous technologies). And let's face it – this stuff is cool. Self-driving cars. Chat bots. Robot dogs.

Organizations are understandably flocking to these technologies, lured by the promise of boosting revenue and/or cutting costs by applying these technologies to do things like create targeted marketing campaigns, roll out facial detection/facial recognition applications, adjudicate credit, manage fraud and other risk, and deploy "smart"/connected devices. Companies are finding themselves embracing entirely new business models (e.g., informationalization of existing products and services, where organizations build in data that customers need; infomediation, where organizations do not create new data per se, but mediate the exchange of data). Companies adopting and implementing these technologies and business models often overlook the challenges they create for existing privacy programs and compliance processes, as well as their usual contracting practices.

The session covered the following:

  • Things to consider before acquiring a transformative technology: how much is real and how much is hype? And how do you know?
  • How select transformative technologies create unexpected privacy and other compliance challenges and ways organizations can address them
  • Steps organizations can take to manage common risk and liability issues, including via contracts
