Canada: De nouvelles exigences de recrutement en vigueur dans le cadre du Programme des travailleurs étrangers temporaires

Depuis le 28 août 2017, Emploi et Développement social Canada (« EDSC ») demande à tous les employeurs qui souhaitent obtenir une évaluation de l'impact sur le marché du travail (« EIMT ») afin de confirmer une offre d'emploi faite à un ressortissant étranger d'afficher cette dernière sur le site Guichet-Emplois du gouvernement du Canada (le « site Guichet-Emplois »), quels que soient la province ou le territoire concernés. Ainsi, les employeurs des provinces qui possèdent leur propre site d'emplois, soit la Colombie-Britannique, la Saskatchewan et le Québec, doivent désormais publier les postes à pourvoir sur leur propre site d'emploi provincial et sur le site Guichet-Emplois. Les employeurs qui optent pour d'autres méthodes d'affichage doivent justifier et expliquer leur choix par écrit.

Jumelage emploi

Les employeurs doivent de plus utiliser Jumelage emploi lorsqu'ils affichent un poste sur le site Guichet-Emplois. Ce nouveau service a été conçu afin de permettre aux employeurs de consulter les profils anonymes de chercheurs d'emploi inscrits qui correspondent aux exigences et compétences recherchées dans l'affichage de poste. Le système Jumelage emploi évalue les candidats à l'aide d'un système de classement, en leur attribuant entre 1 et 5 étoiles. Plus un jumelage aura d'étoiles, plus la compatibilité entre le poste affiché et le chercheur d'emploi sera importante.

Les employeurs qui souhaitent pourvoir un poste pour une rémunération égale ou supérieure au salaire horaire médian de la province ou du territoire (c.-à-d. un poste à haut salaire) sont tenus d'inviter tous les chercheurs d'emploi dont le profil a été jumelé à l'offre au cours des 30 premiers jours de sa publication à postuler s'ils ont reçu quatre étoiles ou plus. Dans le cas des postes à faible salaire, les employeurs doivent inviter tous les candidats à qui au moins deux étoiles ont été attribuées à répondre à l'offre dans les 30 jours qui suivent son affichage. Il n'est toutefois pas clairement indiqué si les employeurs doivent offrir une entrevue à tous les chercheurs d'emploi invités à poser leur candidature en vertu du nouveau système.

Professions dispensées de l'obligation de recrutement/d'affichage dans le cadre du Volet des talents mondiaux

Comme nous l'avions mentionné dans notre alerte en matière d'immigration des gens d'affaires publiée le 20 juin 2017, les employeurs désireux d'engager des étrangers qui possèdent des compétences uniques et spécialisées et qui ont été orientés vers EDSC par un partenaire de recommandation désigné ou qui exercent une profession comprise dans la liste des professions exigeant des talents mondiaux échappent aux exigences de recrutement et d'affichage en vertu du nouveau Volet des talents mondiaux. Au 24 août 2017, cette liste comprenait les professions suivantes :

  • Code 0213 — Gestionnaires des systèmes informatiques
  • Code 2147 — Ingénieurs informaticiens/ingénieures informaticiennes (sauf ingénieurs/ingénieures et concepteurs/conceptrices en logiciel)
  • Code 2171 — Analystes et consultants/consultantes en informatique
  • Code 2172 — Analystes de bases de données et administrateurs/administratrices de données
  • Code 2173 — Ingénieurs/ingénieures et concepteurs/conceptrices en logiciel
  • Code 2174 — Programmeurs/programmeuses et développeurs/développeuses en médias interactifs
  • Code 2175 — Concepteurs/conceptrices et développeurs/développeuses Web
  • Code 2241 — Technologues et techniciens/techniciennes en génie électronique et électrique (salaire annuel minimum : 81 000 $, soit un salaire horaire de 38,94 $, ou salaire en vigueur supérieur)
  • Code 2283 — Évaluateurs/évaluatrices de systèmes informatiques (salaire annuel minimum : 78 000 $, soit un salaire horaire de 37,50 $, ou salaire en vigueur supérieur)
  • Code 5241 — Designers dans le domaine des médias numériques; ce poste nécessite un minimum de 5 années d'expérience au sein de l'industrie et des compétences particulières (salaire annuel minimum : 80 000 $, soit un salaire horaire de 38,46 $, ou salaire en vigueur supérieur)

Il n'est présentement pas clair à savoir qu'elle sera l'incidence de ces changements sur le traitement des EIMT concernant les postes de cadre supérieur ou faisant partie de haute direction, pour lesquels les employeurs étaient parfois dispensés de l'obligation habituelle d'affichage sur le site Guichet-Emplois lorsqu'il leur était possible de démontrer qu'il ne s'agissait pas d'une méthode efficace de recrutement et qu'ils disposaient d'autres moyens plus appropriés dans les circonstances (par exemple en ciblant un public ayant la formation, les compétences et l'expérience professionnelle requises pour le poste).

No delay in exercising or non-exercise by you and/or Mondaq of any of its rights under or in connection with these Terms shall operate as a waiver or release of each of your or Mondaq’s right.
