USCIS published a new version of Form I-9 (11/14/2006 ed.), which includes new features for users completing the form on a computer. Employers may use this version immediately in verifying new hires or continue using a previous version dated 03/08/2013. However, as we discussed previously, on January 22, 2017, usage of the newest version will become mandatory.

USCIS has stated that the new Form I-9 is designed "to reduce errors and enhance form completion using a computer." Notably, users now completing the form with PDF software may now click on prompts which provide detailed instructions on completing each form field. An additional feature includes drop-down lists and calendars to ensure consistent completion of certain fields such as document types.

Those completing the form may press a "Click to Finish" button which provides a quick review of the draft form and highlights fields that may have been completed incorrectly. Once printed by the employer, the form will also automatically generate a unique QR code. Additional improvements also include the ability to provide multiple preparers/translators in Section 1 and a dedicated area for adding additional information instead of writing in the margins.

All U.S. employers are required to verify the identity and employment authorization of individuals they hire for employment in the United States on or after November 6, 1986. This requirement applies whether or not the employer sponsors foreign workers. Given the hefty fines that may apply for substantial or even technical violations, Form I-9 compliance is vital for every business.
