As previously reported in Environmental Law News (Fall 2009), the first reports for priority toxic substances from facilities regulated by Ontario's Toxics Reduction Act, 2009 are due June 1, 2011. Regulated facilities are facilities in the manufacturing and mineral processing sectors that meet the NRPI reporting thresholds.

This first reporting requirement applies to regulated facilities using any of the 47 priority substances listed in Table A of O. Reg. 455/09 under the Act. The next significant deadline will be the preparation of toxic substance reduction plans for those substances by December 31, 2011.

The second phase of accounting obligations under the Act for non-Table A toxic substances will commence in January 2012, with reporting and reduction planning by June and December respectively in 2013.
