Nesta quarta-feira, 12, o Ministro Luiz Fux revogou a
própria liminar deferida que suspendia a
aplicação de multas e indenizações
decorrentes do não cumprimento da Tabela de Frete
Mínimo.
A Decisão decorre de pedido de
reconsideração feito pela Advocacia-Geral da
União, que alegou que a medida de tabelamento assegurou o
estado de normalidade das rodovias e de distribuição
de produtos e serviços essenciais à
população. Ministro Fux revogou a liminar por
entender haver periculum in mora inverso, enfatizando que sempre
privilegiou a busca de soluções consensuais.
Portanto, a autorização legal para as
ações de fiscalização da ANTT
está novamente vigente, incluindo a aplicação
das multas instituídas pela Resolução 5.833 da
ANTT, e as indenizações para os transportadores.
