Brazil: Seguros e Resseguros: Deliberação SUSEP nº 206 - Plano de Regulação 2018

Com base na referida Deliberação, os seguintes temas serão objeto de possíveis novas normas no decorrer do ano de 2018:

  • Plano de ação no âmbito de fiscalização prudencial, mediante nova Circular SUSEP e a alteração da Res. CNSP nº 243/2011, além da regulamentação da dispensa de instauração de Processo Administrativo Sancionador (PAS) previsto no art. 2º, § 4º-A, da Res. CNSP nº 243/2011;
  • Criação de Sistema de Monitoramento Eletrônico das operações das Seguradoras, Entidades Abertas de Previdência Complementar, Sociedades de Capitalização e Resseguradores Locais, mediante nova Resolução CNSP, a fim de propiciar maior transparência ao consumidor, que poderá consultar dados de suas apólices, além de permitir à SUSEP atender com maior celeridade demandas de outros órgãos, inclusive Poder Judiciário;
  • Questões de responsabilidade ambiental, social e de governança (ASG), como resultado da participação da SUSEP no Grupo de Trabalho de Títulos Verdes, coordenado pelo Laboratório de Inovações Financeiras (BID, ABDE e CVM), mediante nova Resolução CNSP para incentivo à observância de princípios ASG nos investimentosde investidores institucionais;
  • Política de Conciliação da gestora do Consórcio DPVAT, mediante Circular SUSEP, e provisões técnicas/cálculo tarifário para 2019, mediante Resolução CNSP;
  • Promoção de alterações na Resolução CNSP nº 321/2015 no tocante à liquidez, ao auditor contábil independente, à auditoria contábil independente, à contabilização de salvados e ressarcimentos;
  • Registro contábil das operações de resseguro, manual de contabilidade, Comitê de Pronunciamentos Atuariais e Comitê de Pronunciamentos Contábeis, mediante alteração na Circular SUSEP nº 517/2015;
  • Revisão e consolidação das normas de gestão de Riscos, Controles Internos e Governança Corporativa, mediante alterações nas Circulares SUSEP nº 249/2004, nº 344/2007 e nº 363/2008, entre outras;
  • Proposta de ajuste na Resolução CMN nº 4.444/2015, visando garantir a segurança das operações com derivativos e fundos de investimento sem inviabilizar investimentos que se mostrem vantajosos para as supervisionadas e para os participantes de planos de previdência e de seguro de vida por sobrevivência;
  • Consolidação dos normativos que tratam das regras para transferências de carteiras;
  • Resolução CNSP que trate de princípios e política institucional dos mercados supervisionados;
  • Circular SUSEP que trate de fiança locatícia, complementando a Circular SUSEP nº 347/2007;
  • Resolução CNSP que trate de seguro prestamista;
  • Flexibilização do envio de condições contratuais, mediante alterações das Circulares SUSEP nºs 256/2004 e 265/2004;
  • Aprimoramento da comercialização do seguro garantia estendida, promovendo alteração da Resolução CNSP nº 306/2014;
  • Resolução CNSP que simplifique as regras para Responsabilidade Civil do Transportador Rodoviário (RCO);
  • Circular SUSEP que disponha sobre tábuas de morte e invalidez;
  • Circular SUSEP que disponha sobre seguro pecuário e de animais;
  • Resolução CNSP que estabeleça diretrizes gerais e previsão regulamentar da aceitação de riscos de exterior pelas resseguradoras locais;
  • Projeto de Lei para simplificar os critérios de cobrança da Taxa de Fiscalização;
  • Delimitação das hipóteses em que dias não úteis, de maneira geral, ensejam adiamento da entrega do FIP, estabelecimento do protocolo de processamento como prova de entrega do FIP e revisão das regras para realização de recargas do FIP, promovendo alteração da Circular Susep nº 517/2015.

O plano de regulação elenca ainda algunstemas principais para estudos normativos:

  • Exigências normativas impostas às microsseguradoras, a fim de fomentar o setor;
  • Criação de um Comitê de Produtos nas entidades supervisionadas, responsável pelo acompanhamento dos produtos do início ao fim;
  • Atuação das supervisionadas como investidores institucionais alinhados à política econômica;
  • Limite de retenção por grupo econômico e limite máximo também para o ressegurador;
  • Capital de risco de subscrição de vida e previdência;
  • Fundos de Investimento constituídos por Entidades Abertas de Previdência Complementar e por Seguradoras;
  • Estudos para excepcionalizar certos casos sobre Redução ao Valor Recuperável.

Finalmente, como pendências com relação ao plano de regulação de 2017, foram listados os seguintes pontos:

  • Revisão da Circular SUSEP nº 205/2002, que dispõe sobre o recolhimento da taxa de fiscalização no que diz respeito a UFs (Unidades Federativas);
  • Revisão da Deliberação SUSEP nº 055/2001, que dispõe sobre procedimentos de arrecadação e parcelamento de débitos da taxa de fiscalização, multas pecuniárias e outros;
  • Estudos dos impactos da adoção do IFRS 9 e 17 na classificação de ativos e nos resultados das companhias, propondo as devidas alterações no plano de contas;
  • Proposta de ajuste na Resolução CMN nº 4.444/2015, visando corrigir omissão relacionada à falta de referência ao modo de aplicação das provisões relativas à reversão de resultado financeiro;
  • Revisão dos normativos que tratam de capitalização;
  • Revisão dos normativos que tratam da guarda de documentos;
  • Revisão dos normativos que tratam da concessão de assistência financeira pelas entidades abertas de previdência complementar e seguradoras e a atuação dessas empresas como correspondentes de instituições financeiras autorizadas a funcionar pelo BACEN;
  • Regras e critérios para estruturação, comercialização e operacionalização do Seguro de Vida Universal.

A divulgação da atualização do Plano de Regulação SUSEP para o ano de 2018 é importante para que o mercado acompanhe a atividade do regulador e entenda as perspectivas e tendências regulatórias.
