It was published today in the Official Gazette Circular SECEX 39, of June 19, 2015, issued by the Secretariat of Foreign Trade, initiating an anti-dumping investigation in Brazil on the imports of poly (Polyethylene terephthalate), also known as PET resin with intrinsic viscosity between 0.7 and 0.88 dl, from China, Chinese Taipei, India and Indonesia.

The product under investigation is commonly classified under the position 3907.60.00 of the Mercosur Common Nomenclature (NCM).

The investigation was requested by M&G Polímeros Brasil S/A, representing the domestic industry.

The period of investigation for the analysis of dumping and from the analysis of injury is from January 2010 to December 2014.

The argued dumping margins are 39,3% for China, 35,6% for Chinese Taipei, 31,2% for India and 12,5% for Indonesia.

Because China is not considered as a market economy country in Brazil, the domestic industry appointed Chinese Taipei as the third market economy for the purpose of calculating the normal value. This choice can be challenged by the exporters.

The interested parties (producers/exporters from the investigated country, as well as the Brazilian importers) will receive Questionnaires in the next days, to be responded and returned to the investigating authorities within 40 days.

The cooperation allows an exporter to have control over the outcome of the investigation and to ensure that any duties imposed are based on accurate data. Moreover, the cooperating exporters may be subject to individual dumping margins, which tend to be lower than the "all others" margin. In this context, we strongly advise exporters from the investigated country to participate in this investigation.

It is very important that exporters of this product from the investigated country provide detailed responses to the questionnaires on the due date, in order to allow the authorities to apply lower anti-dumping duties to the exports from the investigated origins to Brazil, or no anti-dumping duty at all.
