Australia: Planning Reform Update - There´s Movement At The Station...But Where Has The Urgency Gone?

A handful of the NSW Government's planning reforms commenced this week. However, in circumstances were the new legislation was rushed through with incredible speed, the NSW Government has now revealed that it will be up to 12 months before "most" of the new planning laws actually commence, with much of the detail yet to be prepared.

The Environmental Planning and Assessment Amendment Act 2008 was assented to by Parliament at 2:00am on 25 June 2008 after having been prepared and publicly exhibited at breakneck speed. Undoubtedly, the package of reforms is the most significant overhaul of planning laws in NSW since the Environmental Planning and Assessment Act was introduced in 1979. Other reforms were simultaneously introduced in relation to the system of development certification in NSW. A Planning Circular issued by the Department of Planning last week states that although some of the planning reforms commenced on Friday 1 August (these were only the reforms that did not need any supporting regulations to be drafted), most of the reforms "will be commenced in stages over the next 12 months as necessary regulations, guidelines and changes to the accreditation scheme are prepared". Many critics of the planning reforms objected to the package proposed by Minister Sartor on the basis that much of the important detail had not been revealed - being left to regulations and guidelines. The Department's new Planning Circular seems to confirm that indeed much of the detail is a long way off.

Consistent with that, many readers will recall that one of the Government's main reform proposals was to increase the range and uptake of 'exempt' and 'complying' development by adopting housing codes – meaning houses that met certain criteria would not need any development application or council approval at all. Although two draft housing codes were hastily released for public comment in May 2008 (prior to approval of the planning reforms by Parliament), there has subsequently been no further information released since that time. At least a dozen further housing codes are yet to be released. gadens lawyers was recently informed by the Department of Planning that these would not be released until at least late this year.

There is no news yet as to exactly when the all-important changes to the development assessment processes in NSW will commence, or when the new consent authorities (such as the Planning Assessment Commission, Joint Regional Planning Panels and Planning Arbitrators) will commence assessing development applications in NSW – taking that approval role out of the hands of local Councils

The reforms that have commenced this week are generally of a minor nature in terms of general planning laws, but will be of increased significance to certifiers in NSW, and include:

  • increased penalties for carrying out building work without a construction certificate, or without having appointed a certifier (up from $33,000 to $110,000)
  • Environmental Planning Instruments (LEPs and SEPPs) can now restrict certifiers from issuing subdivision certificates - for example, by requiring a private certifier to obtain the council's approval before issuing a subdivision certificate (s.109D)
  • for building or subdivision work commenced after 1 August 2008, there will now generally be a ten-year limitation period in which any proceedings can be brought in relation to any building work, whether or not a final occupation certificate has been issued. This affects the insurance cover the certifiers must maintain
  • the Building Professionals Board can now take urgent action to cancel or suspend the licenses of accredited certifiers who, in the Board's opinion, are not fit and proper persons to hold a certificate of accreditation
  • there are some revision to the complaint procedures and penalties that apply when the Building Professionals Board investigates complaints against certifiers.

A representative of the Department of Planning stated in a media release on Friday that "Tightening up rules and increasing penalties for accredited certifiers was always identified as a priority and therefore these reforms are among the first to come into effect."

It has to be said however that in all other respects, the planning reforms that have now commenced are very minor in the scheme of broad-scale planning reforms that were rushed through Parliament earlier this year. The extreme urgency with which the NSW Government approached its task now seems to have lost some of its steam.
