Fashion too hot to handle - Givenchy and Ivanka Trump's lines recalled due to burn risk

Givenchy and Ivanka Trump have recently been burnt, with items from their recent collection being recalled by the US Consumer Product Safety Commission (CPSC) for posing a serious risk of burns to consumers.

Three lines of Givenchy's men's silk-based shirts from its Spring/Summer 2016 collection were recalled for failing to meet the federal flammability standard. The prices ranged from $685 - $1,350 and approximately 60 were sold in the US.

Similarly, Ivanka Trump's watercolour rayon scarf also failed to meet the flammability standard (these were made off-shore in China). The price range here was between $12 - $68, and 20,000 scarves have since been recalled.

Both these product lines were sold through brick and mortar stores in the US, but also made available internationally through online stores such as MyTheresa and Amazon.

The CPSC's jurisdiction is limited to the US, and so the recall only applies there. This means these products may still be available to purchase outside the US. We suggest you don't.

In Australia, the ACCC has the power to recall a product if it considers it to be unsafe or likely to cause injury to a person (even if it is misused in a reasonably foreseeable way) and consumers may return the products for a full refund.

The lesson here is:

  1. be across all quality standards of the market(s) you are selling in, particularly if your products are made off-shore; and
  2. ensure your supply chain is well managed at each stage to comply with those standards.

As the above cases show, whether you manufacture at the high or lower end of fashion, your exposure is the same.
