Further to our previous update on 29 September 2015, the Wrongs Bill 2015 ("The Bill") was introduced and read for a first time in the Legislative Council on 8 October 2015. It was then read a second time, voted on and passed without any amendment.
The Minister for Training and Skills, the Hon. Steve Herbert MLC spoke to the Bill and said that it will effectively "...make it easier for certain types of claimants to access compensation for their injuries" because, as mentioned in our previous release it gives claimants access to damages for non-economic loss which, under the current Act they would be denied. This means that more claimants will now be able to recover damages for pain and suffering.
Readers should note that the Bill is expected to become 'operative' once it receives Royal Assent, which is likely to occur over the next week or so.
