The Freedom of Information (FOI) Commissioner's website has now been established.

Under the new review procedures:

  • Agencies will no longer conduct formal internal reviews of their decisions.
  • Instead, requests for formal reviews should be made directly to the FOI Commissioner at the addresses shown on the new website.
  • The Commissioner may ask an agency to assist her in reviewing its original decision.
  • Agencies may still reconsider their decisions and make fresh decisions at any time in the process.

The FOI Further Amendment Regulations 2012 have amended the FOI Regulations 2009. The amendment has now prescribed:

  • The authorities to which the FOI Commssioner can refer a matter under section 49O(5) of the Freedom of Information Act 1982 (Vic) (FOI Act).
  • The agencies which can be compelled under section 61J of the FOI Act to produce documents to the FOI Commissioner.
