On October 3, 2016, the Province of British Columbia released the long-awaited disclosure regulation made under the Franchises Act, and has set February 1, 2017 as the date that the legislation and regulation come into effect.

In our last update we reported that the B.C. government was to base these regulations on the Uniform Law Conference Of Canada's template franchise regulation, and recommendations set out by the British Columbia Law Institute in its proposed Franchise Act (Disclosure) Regulation. Franchisors will be pleased to know that this seems to be the case, as the Franchises Act Regulation, which is available here [PDF], largely mirrors the disclosure regulations in other provinces.

We will be reviewing the B.C. Franchises Act Regulations immediately, and we will provide another update in the coming days.
