The Federal Clean Air Act ("Act") allows individuals seeking Title V Operating Permits from state agencies to seek federal review of state permitting decisions.  Over time, petitions for federal review have raised increasingly more complex policy, legal and technical issues, which is putting an ever-increasing burden on the EPA to review state permitting decisions.  In response, the Environmental Protection Agency ("EPA") has proposed a set of formal requirements which would allow for more efficient processing of petitions seeking agency review.  The proposed rule would establish minimum content requirements for petitions for review, and a standard format that all Title V review petitions must meet.  The new requirements are designed to ensure the completeness of petitions before they are filed, while also improving the EPA's ability to review petitions in a timely fashion.
