As reported in our January Communiqué, the Stronger Workplace for a Stronger Economy Act is now in effect.

This post serves as a reminder to employers in Ontario that key legislative changes impacting temporary help agencies and their clients will be effective on November 20, 2015. Key changes to the Employment Standards Act, 2000 include the following:

  • Joint liability for temporary help agencies and their clients for the unpaid wages of assigned employees.
  • Temporary help agencies and their clients will be required to record the number of hours worked by each assignment employee in each day and each week.
  • Enhanced record keeping requirements for both temporary help agencies and their clients.

In light of these changes, employers are encouraged to review their practices and their agreements with temporary help agencies to ensure compliance.
