In the case of Iskanian v. CLS Transportation, the California Supreme Court ruled on June 23rd that the 2007 Gentry California high court decision, which was used to instigate invalidation of class waivers, was overruled by the Federal Arbitration Act. However, the court maintained that representative representative claims under California's Private Attorneys General Act (PAGA), which permits employees to sue on behalf of current and former workers for violations of California Labor Code, could not be waived, as it runs counter to public policy.

The result of this ruling led to the California Supreme Court reversing the judgment of Arshavir Iskanian's proposed wage class action against CLS.
