H&M Co. Inc. asked a California federal judge to dismiss a lawsuit claiming the retailer infringed copyrights by using an iconic photo titled "LA Fingers" on t-shirts, saying the complaint is deficient.

The suit was tossed last month, but the plaintiff was given a chance to refile trimmed-down infringement claims earlier this month.

H&M believes that there was no copyright infringement because the use of the image was free speech and that the image shows uncopyrightable, generic elements.
