1. What is a DPCO

A 'Data Protection Compliance Organisation (DPCO) means any entity duly licensed by the National Information Technology Development Agency (NITDA) for the purpose of training, auditing, consulting and rendering services and products for the purpose of compliance with this Regulation or any foreign Data Protection law or regulation having effect in Nigeria'.

2. Who needs a DP Who needs a DPCO and why?

Essential every Data Controller or Data Administrator needs the protection of their data. A Data Controller is a natural or legal person who collects, controls, processes or is otherwise in posession of personal data, while a Data Administrator is a natural or legal person who posesses personal data, usually on the instruction of the Data Controller.

The National Information Technology Development Agency (NITDA), created in April 2001 is a public service institution established as the ICT policy implementing arm of the Federal Ministry of Communication of the Federal Republic of Nigeria. The National Information Technology Development Act 2007 empowers NITDA's operations.

4. What is NDPR?

The Nigeria Data Protection Regulation (NDPR) 2019 was issued on January 25th, 2019 by NITDA as a mirror of the European Union's General Data Protection Regulation (GDPR).

5. What form of protection is provided by virtue of the Nigeria Data Protection Regulation (NDPR)?

Section 2.6 of NDPR 2019 provides that Data controllers or Data Administrators will give adequate Data Security, as it holds that:

"Anyone involved in data processing or the control of data shall develop security measures to protect data; such measures include but not limited to protecting systems from hackers, setting up firewalls, storing data securely with access to specific authorized individuals, employing data encryption technologies, developing organizational policy for handling personal data data (and other sensitive or confidential data), protection of emailing systems and continuous capacity building for staff.''
